Mall Shooting Cases We’ve Handled

Unfortunately, local shopping malls such as Town Center at Boca Raton and Melbourne Square Mall are no stranger to shootings and other injuries that can be traced back to negligent security and carelessness on the part of mall ownership. In fact, David Shiner, our founding attorney, has handled shooting incidents in both of these locations.

Town Center at Boca Raton Murder Bochicchio Case

Although this murder took place in December 2007, the case is still fresh in many Floridians’ minds. Nancy and Joey Bochicchio, a mother and her seven year old daughter, were brutally shot in the mall parking lot after apparently being targeted by the killer while shopping at the Town Center at Boca Raton. Attorney David Shiner represented Bochicchio’s sister, JoAnn Bruno, in a lawsuit against the mall owner, Simon Property Group, for failing to take measures to protect its patrons even after being put on notice about security issues.

August 7 of the same year, a carjacking and abduction had been reported at the mall. Attorney Shiner remarked that this event wasn’t made sufficiently public and that patrons were not aware that they needed to take extra precautions. In addition, the mall failed to provide adequate security personnel, even in light of the violent crimes that could occur.

Recent Shooting at Melbourne Square

On December 13, 2016, a man attempted to rob a family of three in their car in the parking lot of Melbourne Square. When the driver got out and confronted the robber, a physical altercation occurred and the gun was shot, although it injured no one. Although the mall released a statement saying that safety is their top priority, multiple shootings such as these have left many wondering whether their words are backed by their actions. Attorney David Shiner has also handled a case involving Melbourne Square. Mall negligence cannot be tolerated and victims may be able to hold the mall owners accountable for their injuries.

I slipped and fell in a mall, can I pursue a slip and fall lawsuit?

Whether due to a mall shooting or due to another incident, slip and fall accidents can occur. Unmaintained premises can pose serious risks to patrons. Slip and fall accidents fall under the overarching category of premises liability claims, meaning that property owners have a duty to keep the premises reasonably safe for whomever may step foot on it.

Common causes of slip and falls include the following, and more:

  • Slippery floors
  • Broken handrails
  • Malfunctioning escalators
  • Broken doorknobs
  • Uneven flooring
  • Uneven rugs or carpeting

In many cases, these factors are present in malls because they do not have enough staff to keep the premises reasonably clean and safe, or because the staff are not held to reasonably high standards and are negligent in completing various tasks or maintenance.
