Boca Raton Town Center Mall Murder
The experienced Boca Raton Premises Liability and Accidental Death Attorneys at Shiner Law Group handle wrongful death cases involving premises liability and negligent security. Notably, our firm successfully pursued a wrongful death claim against several property owners in connection with the widely publicized 2007 murders at the Boca Raton Town Center mall.
On December 12, 2007, Town Center mall security guards found Nancy Bochicchio and her 7-year-old daughter, Joey, in the back seat of Nancy’s SUV. The car was still running, and both Nancy and Joey had been shot to death. They were bound with plastic ties and duct tape and were wearing swimming goggles with the lenses blacked out. While a small amount of information continues to surface, the murders remain unsolved to date.
In instances like these, the civil justice system can provide relief where the criminal system cannot. Shortly after the deaths of Nancy and Joey, we discovered Town Center mall had been the site of several violent crimes, including a theft and kidnapping with details alarmingly similar to what law enforcement knew about Nancy and Joey’s case. We believed the mall had been notified of security issues, yet it did nothing to correct them. We promptly filed a lawsuit on behalf of Nancy’s sister, JoAnn Bruno, alleging the mall property owners failed to take appropriate measures to protect their patrons from harm. Our lawsuit named Simon Property Group, Sears Roebuck and Co., Bloomingdale’s Boca Raton Real Estate Inc., Burdine’s Real Estate, Inc., and five individual trustees.
We were able to resolve the claim, and the mall initiated security measures to keep people safe in the future, including continuance patrol presence and additional surveillance cameras. Where the criminal investigation has thus far been unable to provide relief in this tragic situation – despite diligently investigating about 2,000 leads – Shiner Law Group held the property owners accountable and delivered some vindication to Nancy and Joey’s family.
Negligent Security Claims
Property owners in Boca Raton and throughout the state of Florida have a legal obligation to maintain a safe place for their patrons. At all times, they must secure the property in a way that protects people from foreseeable harm. When they fail to do so and someone is injured, our attorneys can file a lawsuit for negligent security. Some of the unsafe circumstances we have seen take place on Florida properties include:
- Lack of parking lot surveillance
- Poor lighting
- Broken or disabled locks at entries and exits
- Inadequate performance of security guards
A lack of adequate security can lead to serious injuries and even death. These claims also often involve a complex corporate web that can make it incredibly difficult to discern who actually owned the property in question and who should be sued. In cases like Nancy and Joey’s, where injuries occur at a property location with multiple stores and owners, it can be more difficult still to determine how to proceed. But Shiner Law Group’s lawyers will pursue the most complicated cases against major corporations and achieve results for victims and grieving families. We understand corporate structure and will aggressively battle insurance companies to bring justice to our clients and their loved ones.
At Shiner Law Group, we recognize the turmoil of being harmed in or losing a loved one to an incident of negligent security, and we work tirelessly to deliver any possible closure.
