Fort Lauderdale Scooter Accident Lawyer

Electric scooter riders have the same rights on the road as bicyclists under Florida law, and the companies and drivers who cause crashes can be held responsible. - Under Fla. Stat. § 316.2128, scooter riders have the rights and duties of a bicyclist. No license, registration, or insurance is required to ride.
- Claims can be brought against a negligent driver, a property owner, a scooter manufacturer, or a rental company, depending on what caused the crash.
- Rental app waivers do not protect a driver who hit you, and they do not end every claim against the operator.
- Keep the scooter if you own it, screenshot your ride in the app, and photograph the unit number if it was a rental.
Electric scooters are everywhere in Fort Lauderdale, from personal scooters used to get to work or class to rentals in some parts of town. They are fast, light, and easy to ride, and they share space with cars, bikes, and pedestrians on roads and sidewalks that were not designed for them. A rider has almost no protection in a crash, so even a low-speed fall can mean a broken wrist, a fractured skull, or a serious facial injury.
The U.S. Consumer Product Safety Commission estimates 79,300 emergency department visits tied to e-scooters in 2024, and it has received reports of 206 e-scooter deaths from 2017 through 2024. Locally, FLHSMV counted 1,008 bicyclist crashes in Broward County in 2024, a category that includes other cyclists, and the same drivers who fail to see bicycles fail to see scooter riders.
Shiner Law Group has represented injured Floridians since 2002 and has recovered more than $500 million for our clients. We identify every responsible party: the driver, the scooter maker or seller, a rental operator, and property owners who left dangerous conditions. When a battery fire or mechanical failure is involved, our Fort Lauderdale product liability lawyers work the defect side of the case.
Scooter Injuries by the Numbers
Figures from the U.S. Consumer Product Safety Commission (CPSC) and FLHSMV. CPSC notes that its recent-year death counts are likely incomplete.

Florida gives scooter riders the rights and duties of a bicyclist and lets cities set local rules, including minimum ages.
Common Causes of Scooter Crashes
Most crashes involve one or more of these factors.
Turning and merging drivers
Drivers turning left or right across a rider’s path, pulling out of driveways, or merging without seeing a small, fast scooter.
Car doors
Parked drivers and passengers opening doors into a rider’s path, a common hazard on downtown streets and near rideshare pickups.
Road and sidewalk hazards
Potholes, broken pavement, debris, and uneven sidewalks. Claims against a city or county carry special notice rules.
Defective scooters
Brake failures, stem and folding-mechanism breaks, throttle problems, and lithium-ion battery fires.
Poorly maintained rentals
Shared units ridden by many users can have worn brakes, loose parts, or faulty lights if the operator does not maintain them.
Impaired and distracted driving
Drivers on phones or under the influence, especially at night around downtown, the beach, and Las Olas.

Bicyclist rights and duties
A scooter operator has all of the rights and duties of a bicycle rider. Drivers must give riders the same care they owe cyclists.
No license or registration
Scooters do not have to be registered or insured, and riders do not need a driver license.
Local rules
Cities and counties may regulate where scooters can operate and may set minimum age requirements by ordinance.
Comparative fault
Insurers often argue the rider was going too fast or riding where they should not. If you were 50% or less at fault, you can still recover, reduced by your share.
Claims against government
When a city or county road defect caused the crash, sovereign immunity limits apply and written notice is required before suit.
Filing deadlines
Most negligence claims must be filed within 2 years. Product defect claims and claims against government agencies have their own rules.
What to Do After a Scooter Crash
Get medical care
Call 911 for serious injuries. Head and facial injuries are common, so get checked even if you feel fine.
Document the scooter
Photograph the scooter, its unit or serial number, and any damage. If you own it, keep it as is. Do not repair it.
Screenshot the app
For rentals, save your ride history, receipt, time stamps, and any error messages before the data becomes harder to get.
Identify the driver and witnesses
Get the driver’s name, plate, and insurance, plus witness names and nearby cameras.
Photograph the scene
Capture the road surface, potholes, lighting, signs, and where the crash happened.
Talk to a lawyer before signing anything
Rental companies and insurers may send releases or ask for statements. Get advice first.

What are a scooter rider’s rights under Florida law?
Under Fla. Stat. § 316.2128, a person operating a motorized scooter or micromobility device has all of the rights and duties of a bicycle rider. Riders do not need a driver license, and scooters do not have to be registered or insured. Local governments may add rules, such as where scooters can ride and minimum ages.
How common are e-scooter injuries?
The U.S. Consumer Product Safety Commission estimates 79,300 emergency department visits involving e-scooters in 2024 and has received reports of 206 e-scooter deaths from 2017 through 2024. In Broward County, FLHSMV recorded 1,008 bicyclist crashes in 2024, with 951 people injured and 22 killed.
Will insurance cover my scooter accident?
It depends on the facts. The at-fault driver’s liability insurance may cover your injuries, and your own auto policy’s PIP or uninsured motorist coverage may apply in some situations. A rental operator or scooter maker may also carry coverage. We review every policy that could apply.
I signed a waiver in the rental app. Can I still make a claim?
Often, yes. A rental agreement cannot waive your claim against a driver who hit you, and waivers do not always protect an operator against claims for poor maintenance or defective equipment. Save the app records and talk to a lawyer before signing anything else.
Who is responsible if my scooter malfunctioned?
Possibly the manufacturer, the importer or seller, or a rental company that failed to maintain the unit. Keep the scooter and its battery, do not repair it, and photograph everything. Defect cases depend on preserving the product.
